TERMS OF USE & SERVICE

ACCEPTANCE OF TERMS OF USE

These TERMS OF USE govern your use of the Nassau Firewood web site and your online purchase agreement. By using, visiting, placing online orders or browsing this web site, you accept and agree to be bound by these TERMS OF USE. These TERMS OF USE affect your legal rights and you should read them carefully.

ORDERS MAY ONLY BE PLACED BY U.S. RESIDENTS AT LEAST 18 YEARS OF AGE

The use of the Nassau Firewood online shopping cart and secure checkout is open to U.S. Residents at least 18 years of age. Nassau Firewood is not responsible, and will not honor, purchases made by persons under the age of 18 or purchases made by non-U.S. residents.

PAYMENTS

Nassau Firewood orders are prepaid via credit card ONLY (Visa, Mastecard & Discover). We do not accept cash or check payments.

DELIVERIES

Nassau County deliveries ended in 2019

PICK UP

Nassau Firewood has limited pick up of LOOSE firewood available to REPEAT CUSTOMER ONLY. All pick up are prepaid online & then scheduled for a pick up date.
Customers that do not pick up on their scheduled date will have their order cancelled & refunded. The refund will be 95% of the purchase price. A 5% cancellation fee is charged for credit card & other fees incurred by Nassau Firewood.
Nassau Firewood reserves the right to cancel pick up dates at any time.

Pick ups are done in a public parking lot. Nassau Firewood assumes no liability for customer vehicles. By picking up firewood, the customer releases Nassau Firewood from all vehicle & personal liabilty. The customer assumes 100% liability under their vehicle coverage. By entering the pick up area, the customer acknowledges their vehicle is properly insured & registered. Only a valid NY State licensed driver may operate the vehicle.

PICK UP LOADING SERVICES

LOADING SERVICES ARE NEVER PREPAID. Loading fees are to be paid to the employee that performs the service (in cash).

Nassau Firewood employees may provide loading services during your firewood pick up. LOADING SERVICES INCLUDE THE LOADING OF LOOSE FIREWOOD ONLY. WE DO NOT LOAD INTO CARS. WE WILL ONLY LOAD VEHICLES WITH SUFFICIENT ROOM ( trucks, vans, SUVs, mini vans, trailers, etc.) LOADING SERVICES ARE AT THE SOLE DISCRETION OF NASSAU FIREWOOD. Nassau Firewood reserves the right to levy additional loading fees, or refuse loading of any vehicle. Loading services may be suspended or refused at any time due to high customer volume, poor weather conditions or for any other reason at our discretion.

GUARANTEE TERMS (applies to bagged firewood ONLY)

1. All claims for returns must be made in writing (e-mail) within 14 days of delivery.
2. Firewood appearance or other non-burning characteristics are not guaranteed.
   The guarantee is specific to firewood moisture content only.
3. *Dry firewood is less than 30% moisture content on average as per a calibrated moisture meter.
4. The Kiln Dried firewood must remain in its original packaging.
5. The return must be accompanied by the original Batch Tag(s).
6. All firewood must be stored indoors or adequately covered outdoors. Exposure to moisture voids guarantee.
7. Guarantee does not apply to discounted items, Northern Cut KD, or non-Kiln Dried products.
8. All refunds will be made within 7 days of return restocking.
9. Refunds will be made for the full product purchase price and do not include delivery charges.
10. Delivery fees are non-refundable.
11. Pick-up dates of returned firewood are at the sole discretion of Nassau Firewood.
12. Any exchanges will be made within 7 days of return.
13. A Nassau Firewood Claims Representative must visit your home to determine the validity of the return.
14. One return per household.
15. This guarantee is at the sole discretion of Nassau Firewood and only those aforementioned terms will be honored.

ORDER CANCELLATIONS, EXCHANGES & REFUNDS

Nassau Firewood guarantees our Kiln Dried firewood to be dry as per the conditions of our Guarantee Terms outlined above. Nassau Firewood does not guarantee pick up dates & times, specific firewood packaging or any specific pick up options. We are not responsible for orders picked up by anyone other than the customer that placed order. All claims must be made via e-mail. Verbal claims will not be honored.

Your online purchase is a binding legal contract. Nassau Firewood is obligated to insure the quality & availabilty of the purchased products as shown on your check out receipt. Any substitutions, additions, deletions or other changes in your order may incur additional charges. A MINIMUM 5% RESTOCKING CHARGE WILL BE CHARGED FOR ANY REFUSED ITEMS or ANY NOT PICKED UP. Returned (bagged) items must be fully intact in the original packaging and be accompanied. Nassau Firewood will not issue a full refund for any item returned after 14 days.

Nassau Firewood charges a minimum of 5% for any canceled orders to cover accounting fees, merchant fees and other associated costs incurred. All Nassau Firewood refunds are made within 14 business days of cancellation. Any credit card chargebacks made at customer request will result in full liabilty of total balance of charges. Customers may not chargeback and receive full refund at the expense of Nassau Firewood. Customers will be responsible for additional delivery fees, exchange fees, restocking fees, portions of orders not returned, additional labor and all accounting fees resulting from chargeback.

Nassau Firewood reserves the right to refund any order at any time.

PRIVACY AND PERSONAL INFORMATION

Nassau Firewood is committed to protecting the privacy of the personal information you provide us on our Web site. Any information submitted on the Nassau Firewood Web site is submitted over our secure encrypted 256-Bit connection. Your personal and financial information is never shared with anyone and is used solely for Nassau Firewood transactions.

Any delivery photos taken by Nassau Firewood are the sole possesion of Nassau Firewood. By agreeing to our Terms of Service Nassau Firewood has your permission to use the photos on this web site.

Nassau Firewood hereby grants permission to use the Website as set forth in this Terms of Service, provided that: (i) your use of the Website as permitted is solely for your personal, noncommercial use; (ii) you will not copy or distribute any part of the Website in any medium without Nassau Firewood's prior written authorization; (iii) you will not alter or modify any part of the Website other than as may be reasonably necessary to use the Website for its intended purpose; and (iv) you will otherwise comply with the terms and conditions of these Terms of Service.

GENERAL

You agree that: (i) the Nassau Firewood Website shall be deemed solely based in New York; and (ii) the Nassau Firewood Website shall be deemed a passive website that does not give rise to personal jurisdiction over Nassau Firewood, either specific or general, in jurisdictions other than New York.
